Kern County District Attorneys Office Lies

So I am going through the case file and I notice an entry in the notes from Jay Winn. Winn is a District Attorney's Office Investigator.  DA investigators are part of the same union with Deputy Sheriffs. Winn served as the Treasurer for the union, so he had regular contact with CLEA.

Now I am going to pause right here. If Winn said anything even remote good about my character or health, do you think it would have shown up anywhere in the report from CLEA? Of course not.  But you guessed it, he only had negative stuff to say about me and it all was documented in CLEA's file.  

Making things worse everything he said about me, was flat out false. It can easily be proven false if he or anyone else would just take two minutes out of their life to verify my claim.


CLEA Gets Really Shady

So after my denial I inform California Law Enforcement Associate of my intent to appeal the denial.  Among the many things I was furious about was the continued accepting of my premiums, despite there claim I was not even eligible for benefits.  CLEA said they only accepted payments because I kept information from them until August 2012.  Then things get really shady.

I pointed out and offered to bring in phone records showing in February I was on the phone with CLEA for 45 minutes late on a Friday afternoon.  My question was if I did not discuss my paid administrative leave status during that initials phone call, what in the world were we talking about for 45 minutes?

Hopefully, you took a look at my claim denial letter from CLEA.  A few things are significant in that letter and they tried to manipulate the truth later, but in this post I want to focus on the question of being ineligible due to administrative leave status.

When you search Administrative Leave on the Internet only a handful of professions are mention in connect with the term.  Almost all information on admin leave references its use by law enforcement organizations.  Since it is fairly unique to the profession, is it fair to disqualify someone from insurance coverage for being placed on admin leave?  Especially when your insurance plan is supposed to be custom built to ensure the financial security of police officers.

I was placed on Adminstrative Leave in early 2010.  I went on an unpaid leave of abscense in late 2011 for medical reasons.  I started paying for long term disability insurance with California Law Enforcement Association shortly after graduating the academy in 2000.  Not to brag but I graduated top overall cadet, number two academically behind Robert Winn.  He may seem slow, but the guy is super smart.

I am going to try and keep things as simple as possible and provide documentation to support everything I claim.  My reason for this is even if I am no longer a Peace Officer I still bleed the tan and green I wore for so many years.  I do not want anyone, much less our first responders to be put in the position my family was when I counted on CLEA to supplement my income and they did not.

Before I go on, I hope you take the time to look at all of the different issues I have with the coverage and denial of coverage by CLEA.  Do not make the mistake of just looking at the claimed reason for denial and say, that does not apply to me so I am not worried.

The reason it does apply to you, is because the reason for denial is not in the policy language.  If they can add language to my policy to deny me coverage, why do you think they will not do the same to you?



What happened to me can happen to any police officer and to a lesser degree even you hose draggers out their.  But it is a very real possibility for any first responder.

I am cruising along in my career, ten years on with the department I had already been promoted three times and was just assigned to supervise the largest patrol substation in Kern County.  I had all the special assignments I wanted I knew all the right people.

Over the next few days I will tell you my story of the horrible experience I had with the California Law Enforcement Association.  How they caused financial devastation for me and my family and why they were wrong to do so.  If you have coverage with CLEA as a police officer of fireman you need to read these posts.  Your supplemental disability coverage can and will be cancelled by CLEA, and to add insult to injury they will keep the premiums you paid even when they say you are not eligible for coverage.  They will attempt to lie and add coverage exclusions that simply do not exist in order to deny your claim.
